Pest Control Contract Terms
- Contract Term and Payment
This Pest Control Contract (hereinafter referred to as the "Contract") is entered into between the Customer (as identified by the name and contact information provided during the payment process) and [AVERZION DBA] (hereinafter referred to as the "Company"), collectively referred to as the "Parties." The Contract is for a term of one (1) year, commencing upon receipt of the Customer's initial payment of the $69 monthly fee. The Customer agrees to pay the Company a monthly fee of $69 for the pest control services described herein.
- Pest Control Services
The Company will provide the following pest control services to the Customer:
a) We administer high-grade pesticides specially designed to target scorpions on a quarterly basis. In certain situations, it may require more frequent applications, and the transition to a quarterly schedule could take an undetermined amount of time.
b) Maintenance of the Slick Barrier coating installed by either the Customer or the Company. The Slick Barrier coating will be warranted as long as the Customer is a member.
c) Reapplication of the Slick Barrier coating if the Customer repaints their home.
d) Reapplication of the Slick Barrier coating if the Customer moves to a new home of similar size.
e) Evening and nighttime pest spraying, allowing the Company to identify the sources of pest infestation.
f) Testing of all pesticides on scorpions to ensure effectiveness.
- Scorpion Sightings and Refund Policy
If the Customer sees a live scorpion in their home after the first three (3) months of service, the Company will refund the Customer's $69 monthly fee for that month. The Customer and the Company may terminate this Contract after three (3) or more refunds have been issued within a calander year.
- Contract Termination and Cancellation Fee
This Contract is for a term of one (1) year. If the Customer wishes to cancel the Contract before its expiration, the Customer shall be required to pay the remaining balance of the Contract in full at the time of cancellation.
- Governing Law and Jurisdiction
This Contract shall be governed by and construed in accordance with the laws of the Arizona. Any disputes arising out of or in connection with this Contract shall be subject to the exclusive jurisdiction of the courts of the Arizona.
Disputes
We will take full responsibility for correcting any mistakes or unforeseen circumstances that arise in the normal course of our services, or as stated herein. We are rarely presented with a problem that we cannot solve. We have extensive resources to call upon when needed and are confident in AVERZION coating. We will not refund any monies paid if it has made the appropriate corrections, or the homeowner refuses to allow us to make such corrections. Otherwise, we will refund all monies paid. Any damages not contemplated herein, shall be limited to no more than the refund amount. In extraordinary circumstances that cannot be corrected, damages shall be limited to double the cost of service or $5,000 whichever amount is the lower amount.
By making the initial payment via the provided link, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions set forth in this Pest Control Contract. The Customer's payment serves as their electronic signature and acceptance of the Contract.
