Contract Terms

Definitions

Customer: The individual or entity receiving pest control services. Company: Slick Barrier Pro Pest Control (a 95 Applications LLC Company). Contract: This Pest Control Contract agreement. Services: The pest control treatments and inspections described herein.

Contract Term and Payment

This Pest Control Contract (hereinafter referred to as the "Contract") is entered into between the Customer (as identified by the name and contact information provided during the payment process) and Slick Barrier Pro Pest Control (hereinafter referred to as the "Company"), collectively referred to as the "Parties." The Contract is for a term of two (2) years, commencing upon receipt of the Customer's initial payment of the $89 monthly fee. The Customer agrees to pay the Company a monthly fee of $89 for the pest control services described herein.

Pest Control Services

The Company will provide the following pest control services to the Customer:

a) Monthly administration of high-grade pesticides specifically designed to target scorpions, roaches, ants, bees, mosquitos, and termites.

b) Maintenance of the Slick Barrier coating installed by our company. We will schedule maintenance 1 to 2 times a year to touch up the coating and repair any issues. We may also suggest applying Slick Barrier to other parts of the property for enhanced protection.

c) Reapplication of the Slick Barrier coating if the Customer repaints their home.

d) Reapplication of the Slick Barrier coating if the Customer moves to a new home of similar size in a territory we service.

e) Evening and nighttime pest spraying to effectively identify and target sources of pest infestation, primarily during the summer months when insects are most active.

f) Yearly termite inspections and yearly Slick Barrier inspections.

g) A scorpion-free guarantee: If the Customer finds a live scorpion in their home after the first three (3) months of service, the Company will provide a free month of service. If three (3) free months are given within a calendar year, either the Customer or the Company may terminate this Contract.

Customer Responsibilities

a) Access to Property: The Customer agrees to provide the Company with reasonable access to the property for scheduled treatments and inspections.

b) Preparation for Service: The Customer is responsible for preparing the property for service as instructed by the Company, including securing pets and ensuring areas to be treated are accessible.

Service Scheduling and Notification

a) Scheduling: The Company will notify the Customer of scheduled services in advance. If the Customer needs to reschedule, they must inform the Company at least 48 hours before the scheduled service.

b) Emergency Services: Emergency services outside of regular visits may incur additional charges, which will be discussed and agreed upon with the Customer before service is provided.

Service Guarantee and Limitations

a) Service Effectiveness: While the Company guarantees effective pest control, certain factors (e.g., environmental conditions, structural issues) may affect the efficacy of treatments. The Company will work with the Customer to address such issues but cannot guarantee complete pest elimination under all circumstances.

b) Limitations: This Contract does not cover damages caused by pests or costs associated with repairs to the property. The Company will provide recommendations for mitigating risks and preventing pest infestations.

Insurance and Liability

a) Insurance Coverage: The Company maintains appropriate liability insurance to cover any damages or injuries resulting from services provided. Proof of insurance can be provided upon request.

b) Limitation of Liability: Except as expressly provided in this Contract, the Company shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the services provided.

Amendments and Modifications

a) Amendments: This Contract may be amended or modified only in writing, signed by both the Customer and an authorized representative of the Company.

b) Entire Agreement: This Contract constitutes the entire agreement between the Parties and supersedes any prior agreements, understandings, or representations.

Severability

a) Severability: If any provision of this Contract is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Contract Termination and Cancellation Fee

This Contract is for a term of two (2) years. If the Customer wishes to cancel the Contract before its expiration, the Customer shall be required to pay the remaining balance of the Contract in full at the time of cancellation, including any discounts given for signing the contract.

Governing Law and Jurisdiction

This Contract shall be governed by and construed in accordance with the laws of the State of Arizona. Any disputes arising out of or in connection with this Contract shall be subject to the exclusive jurisdiction of the courts of Arizona.

Disputes

The Company will take full responsibility for correcting any mistakes or unforeseen circumstances that arise in the normal course of our services. We have extensive resources to call upon when needed and are confident in the effectiveness of Slick Barrier Pro coating. Refunds will not be issued if appropriate corrections have been made, or if the homeowner refuses to allow us to make such corrections. Otherwise, we will refund all monies paid. Any damages not contemplated herein shall be limited to no more than the refund amount. In extraordinary circumstances that cannot be corrected, damages shall be limited to double the cost of service or $5,000, whichever is the lower amount.

Communication

The Company and Customer agree to communicate promptly regarding any issues or changes in service. The Company will respond to Customer queries and issues within 48 hours.

Compliance and Safety

The Company adheres to all relevant safety regulations and standards in the provision of pest control services.

Renewal and Termination Process

The Contract will automatically renew for successive one-year terms unless either Party provides written notice of termination at least 30 days before the end of the current term.

Confidentiality

The Company agrees to keep Customer information confidential and only use it for the purposes of this Contract.

Force Majeure

Neither Party shall be liable for any failure or delay in performance under this Contract due to circumstances beyond their reasonable control, including but not limited to acts of God, war, terrorism, pandemics, or natural disasters.

Subcontracting

The Company may subcontract any of the services provided under this Contract, but will remain responsible for the performance of any subcontractors.

Environmental Responsibility

The Company is committed to environmentally responsible pest control practices and uses eco-friendly products whenever possible.
